Justice Department stands behind controversial Tennessee mosque

The U.S. Justice Department filed a legal brief Monday stating its support of the continued construction of a controversial mosque in Murfreesboro, Tennessee, that was targeted by arsonists in August.

In the friend-of-the-court brief - filed in response to a lawsuit brought by local landowners against Rutherford County, Tennessee - the department argued that practicing Islam is a freedom protected under the First Amendment of the Constitution.

"A mosque is quite plainly a place of worship, and the county rightly recognized that it had an obligation to treat mosques the same as churches, synagogue, or any other religious assemblies," said Thomas E. Perez, assistant attorney general for civil rights.

"This is not only common sense; it is required by federal law. The Justice Department is committed to protecting rights of Americans of all faiths to build places of worship and to worship in peace."

The mosque's construction has provoked controversy in Murfreesboro, about 35 miles southeast of Nashville, and statewide. In July, several hundred opponents of the mosque staged a march against the project. Some objected to Islam itself, carrying signs with slogans including "MOSQUE LEADERS SUPPORT KILLING CONVERTS," while others opposed the project for environmental reasons.

Tennessee Lt. Gov. Ron Ramsey publicly criticized the project during a speech in August.

"You could even argue whether being a Muslim is actually a religion, or is it a nationality, way of life, a cult, whatever you want to call it," Ramsey, then a candidate for Tennessee governor, said at a rally.

And a fire in August at the construction site destroyed an earth mover and damaged three other vehicles in what police determined to be the work of one or more arsonists.

The Islamic Center of Murfreesboro has existed in the Murfreesboro area for more than a decade, according to its website, and currently meets about a mile from the site of the future mosque.

The congregation purchased a 15-acre plot in 2009 and announced plans for a center that will include a mosque, educational facilities, a gym, cemetery and various recreational areas, including tracks, pavilions and a playground.

A plywood sign announcing the new center was spray-painted "Not welcome" earlier this year. Another sign went up, but vandals destroyed that, too.

Shortly after the August blaze, Camie Ayash, who is building the mosque with her husband, was standing at the site with other supporters. She and others heard gunshots and called the sheriff's department. The Tennessean reported that moments after the shots, a vehicle drove by with its horn blasting "Dixie."

"That was it for me," Ayash said. "That really scared me."

    Im not a muslim nor am I a radical . I however believe that we all should live in harmony and not judge people for what they wear, who they are, or what they believe in . Its important to understand that not all muslims are the same, and most are not radicals. I have been studing the subject and have met some amazing muslims, but find that sharia law will never be understood by the western world. Sure one can argue it is barberic, and that i agree with. However one needs to realize that many sharia law punishments no longer take place, yet some do. If you steal then amputation of hand will take place. For many this is a harsh punishment. However, in the USA we give a guy 20 years of free meals and phone calls for murder ? This makes no sense. I guess what im trying to say is no one will ever come to an agreement, but being american I do understand they have a right to create their place of worship. Many Muslims are here in the USA because they want freedom, and democracy. If we want to create a change we need to see from the other side of the fence, and educate those who dont understand a different point of view.

      @Reality: The only problem with that is that science is doing the exact same thing in hospitals around the country. Children are undergoing Female Ge-nital Mu-tilation in the guise of surgery everyday. It's not just in religion where this awful practice is happening.

      You your self said or spread that Islam has" did you say" 77 branches? Well my branch does not say what you are saying and wonder which out of those 77 your reading their books and reference what ever they are?
      Beside if interested read the Sira of the Prophet of Islam from birth to death in order to understand who was he in his tribe and get to understand his actions that were at those old hard times. Take a book not Internet after all may false stories being inserted here and there by ill minded or livered ones for religous or political reasons... Beside do not accuse all for strange acts of certain branches that went astray following,worshipping Men they called Holy rather than God, having their own Holy Books made to suite them that is other than the Pure Quran, or those went on with Hadiths endlessly that says that it was said by the prophet or some one over heard the prophet and so on which now as well got mislead far from Pure Quran,Pure Islam and followed what they thought was right but not the actual right so please wake up and be more rational searching for the truth rather than attacking as if it was a personal hatred issue of yours rather than being as a Quest for Truth of thing from the Right Sources,repeat, the Right Sources please.     Muslim scholars tend to find a deeper meaning behind these words. One interpretation: heavenly ho-uris are a rare, incomparable and distinctive kind of virgin precisely because, once deflowered, they become physically v-irginal again for the next s-ex act.

      OMG you are jealous because my God told me if I behave well and dorightous deeds is going to give me a palace in paradise and many lovely and beautiful houris? And all that been mentioned incentives,motives,drive or what ever you call it. You can not imagine how much I look forward to those promised and mainly houris which I though I saw them in my dreams once when I was praying, worshipping and listening to Quran much and since then I been asking God I would get to them and some where else.
      Any way what made you be sure that there would be s#x the way you know it? Whether you well end there with your earthly body ? Or would be having your thing with you there? Adam&Eve were not having those parts until they had eaten the fruit they became and for that reason they were sent to earth that we know today..so can not say how the pleasure of that going to be but still I do not care since with beauties like those I would be happy just to hag and my heart gets the pleasure.
      Therefore do not start jumping all over about things yet not clear for even the most knowledgable Imams if not clear in the Quran or the most reliable prophets Hadith about after life. As it seems after all the peace we are seeking will only be there and not on earth that been deeply spoiled by powerful nations that only think of profits and them selves only and care not for the next generations that are coming and yet to come...!

    Think he said in the story he is caring for women and then come with the story of Bed-uin No-mads? These No-mads ment-ality is different and it is not much about Islam it is more about cus-toms and trad-itions of theirs although they might covered it as Islam since many have some how mixed their cus-toms and trad-itions with reli-gion to suite their way of living, so you see each country has a different cul-ture,cus-toms and trad-itions that was added to give an over all idea as reli-gion!.
    For example circ-umcision is some thing concerning male only in Islam but in some countries or say tribes it is among their cust-oms and trad-itions the circu-mcision of females and some had gone far in to se-wing female pri-vate part to be taken off only on wed-ding day? Therefore do not see why Islam is to be bla-med for some thing that has not appeared in the Holy Quran?

Well same thing applies you will find bea-ting of women in every reli-gious or non reli-gious com-munities in general and not limited to few examples? As for the Quran we were told if to pun-ish women we men are to aban-don their beds until they show obed-ience,comp-liance but we are not told to b-eat our women? Having already explained in previous posts that those who did are either are non reli-gious or are having problems with drinking spi-rits or dr-ags or a couple dou-bting each other or are in some financial problems? Do not think he will come to a similar examples in areas of reli-gious resi-dents, beside the shouting calling for Allah is not a proof enough that they were Muslims since even Arabic Chri-stions or Je-ws would still shout calling the same as Allah is the name of God in all Arabic reli-gions.

      Now about the untouch-ables is what I did not understand much about since I am not familiar with it but I had already explained to him in previous posts that if those he named untouch-ables are females then it must be due to Isla-mic and Asian cul-tures since they related to issues of vir-tue, mai-den, virg-inity which is most important issue to Muslims of their beloved daug-hters that they treasure and safe guarding their families repu-tation among their comm-unity and that I should think is rightful to do?

      He has mentioned some women being kil-led here and there in rel-ation to ho-nor? Well I am not the best judge of that since it is not in the Quran to deal with it alone? Since accu-sation in Islam for adu-ltery has to have four males wit-nessing that they saw that there was an int-ercourse taken place as per sharia law where the unmarried ones commit same would be whi-pped with eighty strokes and the married ones com-mitting the same would be off-icially st-oned to death and not ki-lled as in ass-assination crimes which is not relative to Islam or Quran!?
      This the whole thing what he mentioned although been explained to him before in privious posts he still brings it up calling any explanation given as lies and insisting to accuse Islam and Muslims for religion unrelated issues that relates more to cus-toms and trad-itions of different nations and tribes...

      @Muneef: I am in agreement with what you say. Especially regarding different customs in different cultures. Many times culture is what really determines the actions of people in the name of their religion and not what is specifically written in religious texts themselves. Unfortunately, even though America is founded on the culture of many different countries, a lot of Americans are unwilling to recognise that people from different parts of the world are going to vary in many ways.
      I often wonder about Reality's refusal to change his outlook when evidence is put before him. Or when flaws in his leaps of faith in statistics are pointed out. But I think it is due to an overwhelming distrust of anything religious and a stubborness or shyness to test his theories by talking to actual people instead of putting all his faith in what is written down.

      I think I have missed some thing thar infidelhere reminded me of in other posts that Sura 04:34 says are to beat them in a way of straighten them and not the means of breaking their bones or killing them and not to sleep with them or sleep on their beds until straightened and if not straightened then as final is to divorce them since can not keep against their will and now there are regulations or laws starting that gives the women the right to divorce the man if she does not want him.
      Any way a husband and wife declared in Islam by a written agreement contract where the man and woman can apply all there conditions for the marriage that bonds both of them to it in disputes by any courts Sharia or non sharia courts and most get married from their tribes or family circles having there own tribal customs and traditions.

    Only for the eyes of new members:

    What instigated the attack on the Twin Towers and the Pentagon? The koran, Mohammed's book of death for all infidels and Muslim domination of the world by any means. Muslims must clean up this book removing said passages admitting that they are based on the Gabriel myth and therefore obviously the hallucinations and/or lies of Mohammed. Then we can talk about the location and safety of mosques and what is taught therein. Until then, no male Muslim can be trusted anytime or anywhere.

      @Reality: Context is always important. Obviously the culture in Saudi Arabia, Somalia, and Kenya is vastly different from the culture in the US or England or South America. And saying the way people approach Islam in all areas is the same is to ignore the cultural differences that influence the practice of it. Is Christianity practiced the same way in Mexico as it is in England? No. Because religion, any ideology really, changes when it moves through different hands. If you want to condemn the treatment of women in Somalia, then do so, but placing the blame solely on their religion, is short-sighted.

    I'm glad the brief was filed but I doubt that's the end of the controversy. I don't understand why people can't live and let live. And for all you defenders of the south... it's people like these terrorists of those who are different that are making you look bad. Including the Lt gov. of Tennessee.

      @Mark: Fair enough. But no one has set fire to the site or fired gun shots over gatherings of muslim people here... As fevered as the response has been in NY, it hasn't devolved to this level. But I suppose we have some time until construction is complete.

      What gets me with the Amicus brief filed by the DOJ is that we've never really needed "freedom of religion" when we have a right to free assembly....unless you were to desire validation of a delusional belief system to be included as part of the deal. Official validation of craziness goes against our intent to fight mental illness, but who wants to be reasonable about anything these days? lol :P

And unfortunately the recent events in Gaza has put this situation back to “squ-are one”. And this significant stupidity is driven by the mythical foundations of both religions!!!

      – Bin La-d-en has been cornered under a rock in Western Pakistan since 9/11.

      – Fa-na–tical Islam has basically been contained to the Middle East but a wall between India and Pakistan would be a plus for world peace. Ditto for a wall between Afghanistan and Pakistan.

      – Timothy McVeigh was exe-cuted. Terry Nichols will follow soon.

      – Eric Ru-dolph is spending three life terms in pri-son with no par-ole.

      – Jim Jones, David Koresh, Kaczynski, the "nuns" from Rwanda, and the KKK were all dealt with and either eliminated themselves or are being punished.

      – Islamic Sudan, Dar-fur and So-malia are still terror hot spots.

      – The terror and tor-ture of Muslims in Bosnia, Kosovo and Kuwait were ended by the proper application of the military forces of the USA and her freedom-loving friends. Ra-dovan Karadzic was finally captured on 7/23/08 and is charged with genocide, crimes against humanity and violations of the law of war – charges related to the 1992-1995 civil war that followed Bosnia-Herzegovina's secession from Yugoslavia.

      – And of course the bloody terror brought about by the Ja-panese, Na-zis and Co-mmunists was with great difficulty eliminated by the good guys.

      The idea of freedom of religion was created by our founding fathers on day one as one of the bedrock principles for America. My grandfather escaped the pogroms in Russia to come to this country for religious freedom. He then spent his entire career in the military fighting to preserve the religious liberty and freedom that he felt made our country great.
