Judge’s dismissal of atheist's harassment claim against Muslim makes waves

(CNN) - A protester who ridiculed the Muslim prophet Mohammed claims he was assaulted by a Muslim who was offended by the stunt, but a judge has sympathized with the alleged perpetrator, in a case that has drawn national attention.

Self-proclaimed atheist Ernie Perce marched in a Halloween parade in Mechanicsburg, Pennsylvania last October, dressed in a costume mocking Mohammed.

In a YouTube video he posted, Perce can be seen wearing a long fake beard, a white turban and green face paint, calling out provocative phrases like: "I am the prophet Mohammed! Zombie from the dead!" Perce and someone else in a zombie-themed pope costume are carrying a banner that reads "The Parading Atheists of Central Pennsylvania / Ghoulish – Godless – God-Awful."

Then a man who is not seen on the video can be heard saying, "Take it down." Amid sounds of a scuffle, Perce can be heard saying "Hey, he's attacking me!"

Perce told CNN affiliate WHTM that the man “grabbed me, choked me from the back, and spun me around, to try to get my sign off that was wrapped around my neck."

Based on Perce's complaint, a Muslim named Talaag Elbayomy was charged with harassment. But on December 6, District Judge Mark Martin dismissed the case, saying it was one person's word against another's, and that there was no other evidence or eyewitness testimony to prove that Elbayomy had harassed or touched the alleged victim.

The judge also scolded Perce, saying he’d been needlessly provocative on an issue sensitive with Muslims.

"You have that right, but you're way outside your bounds of First Amendment rights," Martin said, according to a recording Perce made of the court hearing. "I think our forefathers intended that we use the First Amendment so that we can speak our mind, not to piss off other people and other cultures, which is what you did."

The judge went on to point out that in many Muslim countries, ridiculing Mohammed could warrant the death penalty under Islamic law.

Critics say Martin's lecture shows he used Muslim cultural grounds to excuse a deplorable assault, and failed to defend an atheist's First Amendment rights.

"That's greatly disturbing to people that believe in free speech," said George Washington University law professor Jonathan Turley. "You can say things that are hurtful to others. We hope that you don't, but you most certainly can be protected. People like Thomas Paine spent his entire life ticking off people across the colonies."

Former terrorism prosecutor Andrew C. McCarthy, writing on the blog of National Review, accused the judge of allowing the Muslim suspect to invoke a "Sharia defense – what he claimed was his obligation to strike out against any insult against the prophet Mohammed."

And Perce said of Judge Martin, "He let a man who is Muslim, because of his preference of his culture and his way of life, walk free, from an attack."

The judge, in a phone interview with CNN, defended his ruling.

"The commonwealth didn't present enough evidence to show me that this person is guilty beyond a reasonable doubt," Martin said. "That's why I dismissed the case. Nothing as nefarious as what everyone's thinking, that I'm a Muslim or I'm biased. I'm actually a Lutheran."

Martin added that he has served three tours of duty, totaling more than two years, in Iraq and Afghanistan, where he learned more about Muslim culture.

"It just amazes me that people think that I'm biased towards Islam," he added. "I got sniped at once, I got ambushed once, I got attacked by a mob once... I've served close to 27 years in the military - and have gone overseas - exactly to preserve that right [freedom of speech.]”

But Martin also repeated his criticism of the atheist protester. "With rights come responsibilities. The more people abuse our rights, the more likely that we're going to lose them," he said. " We need to start policing up our own actions, using common sense, in how we deal with others."

Attorney R. Mark Thomas, who represented the Muslim suspect, blamed Perce for the Halloween altercation. "The so-called victim was the antagonist," he told WHTM. "I think this was a good dressing down by the judge."

A blog post by the group American Atheists disagrees. "That a Muslim immigrant can assault a United States citizen,” it says, “in defense of his religious beliefs and walk away a free man, while the victim is chastised and insulted... is a horrible abrogation."

    Martin said that it was one man's word against anothers, yet I'm pretty sure a cop had to drag the pederast prophet supporter of the atheist. Just look at the video, it was a fairly crowded street, there must be several eyeball witnesses. Anyway, Martin more or less acknowledges what happened by admonishing the atheist. It's not the first time a judge has used his (retarded) opinion to guide his judgement, but this is the first that it is so flagrantly unconst-itutional.

      the judge didn't take his ability to talk. nor did the judge jail him for speaking his mind. the first amendment was upheld.

      just because you can speak does not excuse you from the consequences. he knew full well what he was doing was ticking off people. he did it anyway then was shocked when he got attacked. duh common sense should have kicked in and told him that would happen. antagonize someone and you will get hurt. i agree with the ruling completely.

      this suit was as stupid as a burgler getting shot while stealing then suing because he got shot.

      You can't possibly be serious. The atheists were dressed up as part of a Halloween parade. The Muslims could have easily walked away if they were offended. Being offended does NOT give you the right to physically attack someone, EVER. The answer for offensive speech, which is what the atheists were engaging in, is more speech in the way of a reply from the Muslims. This is no different than if you were walking down the street and called the lady in front of you fat, and her husband turned around and slugged you. He would have committed a crime against you, and it's called assault and battery, which is what the Muslim did to the atheist in this case.

      12) 38 Russian citizens killed on March 29, 2010 by Muslim women suicide bombers.

      13) The May 28, 2010 attack on a Islamic religious minority in Pakistan, which have left 98 dead,

      14) Lockerbie is known internationally as the site where, on 21 December 1988, the wreckage of Pan Am Flight 103 crashed as a result of a terrorist bomb. In the United Kingdom the event is referred to as the Lockerbie disaster, the Lockerbie bombing, or simply Lockerbie. Eleven townspeople were killed in Sherwood Crescent, where the plane's wings and fuel tanks plummeted in a fiery explosion, destroying several houses and leaving a huge crater, with debris causing damage to a number of buildings nearby. The 270 fatalities (259 on the plane, 11 in Lockerbie) were citizens of 21 nations.

      22) Shariatpur, Bangladesh (CNN 3/30/2011) - Hena Akhter's last words to her mother proclaimed her innocence. But it was too late to save the 14-year-old girl. Her fellow villagers in Bangladesh's Shariatpur district had already passed harsh judgment on her. Guilty, they said, of having an affair with a married man. The imam from the local mosque ordered the fatwa, or religious ruling, and the punishment: 101 lashes delivered swiftly, deliberately in public. Hena dropped after 70 and died a week later.

      as a whole the history of man is so bloody that it dwarfs tour pitiful list. to take your examples and ignore the rest of civilization is burying your head in the sand. muslems are no worse than any other group in the world.

      @ jkirk ~ I beg to differ... I don't believe atheists have quite the record of violence as most major religions. It's funny that we're looked down upon by many religious people of all faiths. This moron, Perce, is in the small and vocal minority. Most atheists quietly go about their lives not worrying about other people's beliefs. Live and let live.

    so what about when people dress like jesus for halloween? the pope? mother teresa? how about satan? ghandi? the point is that every single religion has multiple icons. people will dress up like them for any reason, just cause. doesnt mean that is a degrading action. ive seen a guy downtown that walks around like jesus DAILY!!! and for the zombie part, that just sweetens the deal. muslims are looking for anyway to punish someone for what they call "insulting" their prophet. christians used to do the same thing, but not so much in this part of the world anymore. iam not an atheist, i believe in Our Creator. i do not, however, believe in any organized religion. be it christian, catholic, muslim, what have you. they are all created for fear mongering, and controlling the masses. people need to relax a little, take everything with a grain of salt, and live your lives for yourselves. stop pushing beliefs on other people. to each our own.

      depends. if he burns down your house with gasoline, its a crime and the local police will be involved. if he bombs your house down, then the homeland security people will be involved, and its not a crime, its just an excuse for your country to invade someone in the middle east.

    What are we talking about here ... seperation of church and state goes both ways. The problem is that there is no seperation in the mind of most Muslim's. Church is state. America is going to have to understand that fairly soon...

    In the Muslim mind he defended his faith... In the atheist mind he is free to make fun of any religion with impunity.

    The net here is that religous are to be silent and accept the abuse of ahteists.....

      No, the "net" is that you never resort to violence. The atheists were not being physically violent. I am a minister. I would NEVER attack someone over words. If they assaulted me or mine – maybe then (probably). Religious people say plenty that is abusive as do atheists and every other human being of every type on planet Earth. Never excuses violence as a response to speech.

      I agree with Rev. Jackson. However the problem is that according to the article and the decision of the judge. There was no Evidence and witnesses. So it all came down to a a claim an allegation of the atheist about being "attacked", a he say, I say. The article makes no mention at all, of the muslim person acknowledging or admitting to attacking or assault. The article say that no witness supported or corroborated the claim and the video is dark, it does not shows what exactly happened.

      The after statements of the Judge certainly can/should be questioned, but his decision was based according to him, in the absence of Evidence, proof and witnesses. Of course the atheists are trying to make this a Paramount case that will prove one of the many talking points in their Agenda.
