Teacher who was fired after fertility treatments sues diocese

By Leigh Remizowski, CNN

(CNN) - A teacher at a Catholic school in Indiana is suing the diocese where she worked after being fired because the in vitro fertilization treatments she received were considered against church teachings.

Emily Herx, a former English teacher at St. Vincent de Paul School in Fort Wayne, filed a federal lawsuit against the school and the Diocese of Fort Wayne-South Bend.

She says in the suit filed Friday that she was discriminated against in 2011 after the school's pastor found out that she had begun treatments with a fertility doctor, according to the complaint.

Herx says the school's priest called her a "grave, immoral sinner" and told her she should have kept mum about her fertility treatments because some things are "better left between the individual and God," the complaint said.

You're a proven liar. Prayer doesn’t not; you are such a LIAR. You have NO proof it changes anything! A great example of prayer proven not to work is the Christians in jail because prayer didn't work and their children died. For example: Susan Grady, who relied on prayer to heal her son. Nine-year-old Aaron Grady died and Susan Grady was arrested.

An article in the Journal of Pediatrics examined the deaths of 172 children from families who relied upon faith healing from 1975 to 1995. They concluded that four out of five ill children, who died under the care of faith healers or being left to prayer only, would most likely have survived if they had received medical care.

The statistical studies from the nineteenth century and the three CCU studies on prayer are quite consistent with the fact that humanity is wasting a huge amount of time on a procedure that simply doesn’t work. Nonetheless, faith in prayer is so pervasive and deeply rooted, you can be sure believers will continue to devise future studies in a desperate effort to confirm their beliefs!*!

I'm a bit confused here. First they state she didn't abide by their belief system. What part? Old testament's the Ten Commandments or New Testament Jesus's love your neighbor as yourself. To me it appears THEY didn't adhere to their own belief system.

    ONLY FOR THE NEWBIES:

This teacher might have a problem depending on how the courts view her employment:

    To wit:

    http://abcnews.go.com/blogs/politics/2012/01/supreme-court-backs-church-in-landmark-religious-liberty-case/

"The government must stay out of hiring and firing decisions by a religious organization, even if a minister sues for employment discrimination, the Supreme Court ruled on Wednesday.

Religious freedom groups praised the decision, and especially the fact that it came from a unanimous court."

These arguments about whether prayer would have helped remind me of an old story:

A man is caught in a flood and goes to his roof to escape the raging waters. A boat comes by and offers him a ride to safety but he declines saying "God will take care of me." Later a second boat comes by but the man turns down the offer again saying "God will take care of me." Then a third boat make an offer of a rid but again the man refuse insisting that "God will take care of me.

    The man ends up drowning.

As he enters into Heaven he meets God and his first question is why after living a good life and believing so strongly did God not help him?

God looks at the man and says "I sent three boats."

Science is not evil...it may just be that God has given us the ability to learn to help ourselves. Maybe the Church could open their eyes a little bit wider and see that.

They WOULDN'T HAVE needed science if god had answered their MANY (why don't you just admit it?) prayers..
People who can conceive naturally don't go get medical help, do they?? God believers pray for all sorts of things, of course they pray when it comes to something like this.

Now sit back the fvck down and answer the question. Jack hole.

Certainly not in this case! Then again, look at all the war dead whose safety was prayed for by their families. I buried a friend's son this morning who died of cancer. They are a very religious family. Their prayers did no good. So, by and large, prayer accomplishes nothing but to feed your own, selfish "feel good" smug atti.tude.

Leave it to the religious right to once again take another freedom away from us.This woman, catholic or not is having problems with procreation and because of an ancient belief, she can't get medical help to help her correct said problem. This is another reason I'm catholic in name only because of these laws dating back before the bible. This is 2012,last time I looked, not the middleages as these religious zealots seem to forget.Tell these religious leaders this is why their losing parishioners in droves, because of their seldom used believes,no one follows their song anymore.Women walk to a different drummer today, they don't walk two steps behind a man anymore, they're not just there for cooking, cleaning, making babies, that's old school. They hold jobs, run the house, raise kids, all by themselves, with no men sometimes. So get with the program or face eventual extinction, for being boring old men in robes who have plenty of time on their hands, with nothing to do but chase around women trying to have babies...

Perhaps if the ministry would work for a living, they would realize what the modern world is up to these days. But no, they would rather sit and judge. I left the church – I no longer call myself catholic.

I have seen many women that gave birth after it was ruled medically impossible. Should I reply to other comments I will try to provide a more detailed explanation of the remarks to try to allow you to understand what is being said.

What "facts" do you know about this woman, you wackaloon? You have no medical background, you're not her OBGYN, you aren't her, and your idiocy is laughable. YOU are the one who doesn't have any of the facts; therefore, take your own advice and shove it.

      April 28, 2012 at 12:34 pm |

JIL squawks: "I have seen women...." Who cares what you have "seen", or claim to have "seen"? You aren't privy to others' s3x lives. You don't know how other women became pregnant-unless you're asking them. Somehow, I can believe you'd be just that intrusive and obnoxious.

@Tom,Tom the Piper's Son. It appears you have an ignorant streak as well. The possibility exists that the woman in question may conceive at some future time and you cannot dispute that possibility. I see no reason to indulge your inflated self worth any farther than that.

      April 28, 2012 at 12:41 pm |
    • Tom, Tom, the Piper's Son

So? Do you really believe that she should just wait and hope God will "fix it"? Why? Because you've "seen" women get pregnant when told it was medically impossible?

@ prayer doesn't change anything: my ex-wife had an accident and the doctors in her country told her she couldn't have children. she believed this and prayed for it to be different. nothing changed, until i pushed her to seek another opinion, she went to a doctor and they told her easy fix. the sinues that hold the felopian tubes up to the ovaries had been severed so they didn't touch, they reattached them and now she has a beautiful little boy. science works, prayer doesn't.

      WWJD,

      A prayer just for you:

The Apostles' Creed 2011: (updated by yours truly based on the studies of NT historians and theologians of the past 200 years)

Should I believe in a god whose existence cannot be proven
and said god if he/she/it exists resides in an unproven,
human-created, spirit state of bliss called heaven?????

I believe there was a 1st century CE, Jewish, simple,
preacher-man who was conceived by a Jewish carpenter
named Joseph living in Nazareth and born of a young Jewish
girl named Mary. (Some say he was a mamzer.)

Jesus was summarily crucified for being a temple rabble-rouser by
the Roman troops in Jerusalem serving under Pontius Pilate,

He was buried in an unmarked grave and still lies
a-mouldering in the ground somewhere outside of
      Jerusalem.

Said Jesus' story was embellished and "mythicized" by
many semi-fiction writers. A bodily resurrection and
ascension stories were promulgated to compete with the
Caesar myths. Said stories were so popular that they
grew into a religion known today as Catholicism/Christianity
and featuring dark-age, daily wine to blood and bread to body rituals
called the eucharistic sacrifice of the non-atoning Jesus.

      Amen

      WWJD
Few 100% true Reasons why Atheism is TERRIBLE and unhealthy for our children and living things:

† Atheism is a religion that makes you stupid, ignorant & blind. **Atheism allows people to expand their thinking, wanting to know WHY things happen, not just defaulting to god.
† Atheism is a disease that needs to be treated. **Really? You have proof. What if religion is the disease?
† Atheism makes you post stupid things (90% of silly comments here on CNN blogs are posted by closet Atheists) **Stupidity make people post stupid stuff. Just like your post.
† Atheist are satanic and have gothic lifestyle. **Satanic and gothic? I am atheist, I don't see any devil worshiping items in my house and I am most certainly not gothic.
† Atheists causes problem in our religious society. **Yes, the problem is that religious leaders are losing control of the people, what a problem.
† Atheists are mentally ill, that's why they have no faith. **Nice little label there, if you are not religious, you must be ill.
† Atheism won't take you to kingdom of heaven and paradise. **There is no heaven. Life is here, now, on earth, make the best of it.
† Atheism making you agree with Stalin, Hitler (Denied his faith later), Mao, Pol Pot & other terrible mass murder leaders. Hitler WAS a Christian. Here's a quote from Mein Kampf: "I believe today that my conduct is in accordance with the will of the Almighty Creator." Sure Stalin was an atheist, but he did not commit his crimes in the name of atheism, it was purely political. Hitler and many others, Anders Brevick in Norway for example committed their crimes in the name of god.
† No traditional family lifestyle, no holidays, no culture, boring and feeling 'outsider' **I have a traditional family, wife and 3 children. I celebrate birthdays, I have culture and I am not bored.
† Atheists are angry, drug additcted and committ the most crime. **I am happy and joyful, drug free and have a clean criminal record. If all the Atheists/Agnostics left America, they'd lose 93% of the National Academy of Sciences and less than 1% of the prison population.
† Atheist try to convert people over internet because they feel "safer" behind closet. **Religious people like to convert people over the internet too. Generally, atheists are not out to convert anyone.
† Atheists do not really exist, they just pretend that they don't believe in God and argue with religious people. **I exist and I really do not believe in god.
† Atheists have had terrible life experience, bad childhood and not being loved. **I did have a bad childhood, at the hands of my Christian step father. When I reported him to the priest in our congregation, I was labelled a liar. Now I am atheist, I could not be happier, more loved and content.
† Most Atheists are uneducated... No Atheists could run for presidency. **I hold 2 doctorates and an IQ of 180. Am I uneducated? And you're right, no atheist could be president, not until american get over their irrational fear of atheists.
† Atheism brought upon the French Revolution, one of the most evil events of all of history. **Do you believe that an absolute monarchy and a corrupt clergy with the power concentrated in only a few people is better than a free, democratic society? Do you also believe that the crusades, blessed by the Catholic church were ok?
† Atheism cannot explain the origins of the universe, therefore God exists. **This is not logic. Atheists can explain the origins of the universe. Ever heard of the big bang? Sure it's just a theory, but at the end of the day, the big bang is support by evidence and proofs, you say "God made everything" without offering proof.
† All atheists believe in evolution, which means they don't believe in morality and think we should all act like animals. **Wrong. Morality existed BEFORE christianity. We are a higher order of life than other animals, we are able to live differently.
† The Bible says atheism is wrong, and the Bible is always right (see: Genesis 1:1, Psalms 14:1, Psalms 19:1, Romans 1:19-20) **Really, do you have proof that the bible is ALWAYS right? Remember, the bible is the claim, not the proof. But if you think that the bible is right, you must agree with this passage from Deuteronomy 22:28-29: "If a man is caught in the act of raping a young woman who is not engaged, he must pay fifty pieces of silver to her father. Then he must marry the young woman because he violated her, and he will never be allowed to divorce her." If the bible is ALWAYS right, you must then agree that a woman should marry her rapist.
† Countries where Atheism is prevalent has the highest Suicide rate & Communist countries = Atheism! **You have prof of this? Please cite your sources. The World Health Organisation seems to disagree with you assertation.
**Only 2-3% of the U.S. are Atheists/Agnostics VS. over 90% who believe in God (80% Christians) in the U.S.** **Doesn't mean that the majority is right!!

† † Our Prayers goes to Atheists to be mentally healthy and seek their creator † † **Keep your prayers to yourself.

ATHEISTS WILL BURN IN HELLFIRE BRIMSTONE WHERE THEY BELONG **I'm pretty sure Jesus would NOT approve of this comment. In any case, it's your hell, you burn in it.

@wwjd/atheism is bad/ prayer changes/ idiot: nice to see you stealing material from atheists and re-writing it to fit your agenda........kind of like your bible. lmao. i love how many beautiful names you come up with; however they are all garbage and meaningless. wwjd couldnt' know because he never exsisted. for anyone reading "your" post will automatically know it orginally was wrote by an athiest and targeted christians......let me give you an example of where you failed. "Atheism cannot explain the origins of the universe, therefore God exists.
We are a higher order of life than other animals, we are able to live differently."

next time truly read the material so you don't look like such a fool. but nice try though, i love seeing how well educated you are, i mean as an atheist you are soooo much smarter than i am. lmfao

Here we go again!!I've asked this question in more than one forum, but I'll ask it again:Why is the so-called"Roman Catholic Church"so obssessively concerned with its members'bedroom issues?? Was in vitro fertilization,or rather its reception a stated stipulation of Ms.Herx's employment? Was she required to keep her plans a secret in order retain her job? And frankly, this priest has a lot of gall calling Ms.Herx"a grave immoral sinner";who died and made him God? Both he and his brotherhood are all-too-familiar with the concept of attempting to conceal their crimes and sins from everyone except God;how's that working out for you? I don't recall any mass exodus of lost jobs from the priesthood behind the pedophilia scandals;no accusations leveled against them for being"grave, immoral sinners",or the cowardly bishops who shuffled them around for decades!!So...put a sock in it,priest;you go Ms.Herx, and may the True and Living God bless you in your endeavours to have children!!!

I'll answer your question, Laurence: because they have to try to obscure the fact that the RCC is the most despotic, hypocritical, money-grubbing "religious" organization on earth.
You know, of the old "Do as I say, not as I do" sort.

Ok, so any increase in anytihng is linked to the increase in atheism, right? How about the increase in longevity? How about the increase in our ability to cure and treat diseases? Our ability to develop new sources of energy, new means of transportation, new techniques to improve our health, new surgery methods that are less intrusives, the development of drugs will less side effects, etc.All in all, our quality of life in constantly increasing, and yes, I see a correlation with atheism.By the way, promiscuity, AIDS, teenage pregnancy, etc., is much higher in the USA than in other developped and much less religious countries. You do the math.

You watch how the ACLU and women rights activists nationwide go after this one. This only happens at election time, its like feeding time at the zoo ,when all the religious rightwingers have their annual witch hunts, just not on women, gays, illegals, all under the heading of religious differences. But don't step on any religious hypocrites toes, you might get burned at the stake VIA the rules of witchhuntings of the middleages...

Which church? You seem to be confusing the liberal church in America, versus the church in Rome. The American church uses birth control and accepts female religious members. I know, it's a bit progressive, but this isn't 100 CE Rome.
