Reaction to anti-Islam film fuels debate on free speech versus hate speech

(CNN) - The deaths of the U.S. ambassador and three other Americans amid protests against a film that denigrates Islam has sparked global discussion and debate  about whether there is a line between free speech and hate speech and, if so, where it lies.

“They don’t regard perceived insults to the Prophet Mohammed or the Quran as being protected by free speech, they regard it as a capital offense,” says Peter Bergen, CNN’s national security analyst, referring to protesters in Libya and Egypt, where the U.S. Embassy was attacked, who were angered by the film.

According to The Wall Street Journal, the movie was made by a real estate developer who wanted to portray Islam as a hateful religion.  The attack on the U.S. personnel in Benghazi, Libya, was orchestrated by extremists who used the protests as a diversion, U.S. sources told CNN Wednesday.

“In some of these cases, the people releasing these films or cartoons are trying to make a statement about free speech, which is fair enough,” says Bergen, referring to the film and other provocative recent depictions of Mohammed, Islam’s founding prophet.

"But in some cases they are deliberately trying to provoke," Bergen says. "The film that is at issue is certainly very provocative, the way it treats the Prophet Mohammed, and people who release these things are being very irresponsible."

Newt Gingrich told CNN Wednesday that the United States should seize on the violence spurred by the film “to teach the Muslim world about freedom,” specifically about freedom of speech.

His remarks, echoed by other conservatives on Wednesday, signaled something of a divide in reaction to developments in Libya and Egypt between the political right, which stressed freedom of speech, and the left, which added condemnation of those behind the anti-Muslim film.

"The horrific attacks in Libya & Egypt are a stark contrast to our American ideals of free speech, civil disagreement," wrote Todd Rokita, a Republican U.S. congressman who is from Indiana, on Twitter.

Gingrich, the former presidential candidate and speaker of the U.S. House of Representatives, said that after the attacks, “We had an opportunity to stand up and say, ‘You know, it is true - some people in the United States might make a film that is totally whacked out.’”

“Sooner or later, we in the modern world have to say to those who are living in a different way, ‘Look, we stand for freedom,’” he said.

Gingrich criticized statements from the U.S. government that he said went too far in condemning and apologizing for the anti-Muslim film.

In a statement on Tuesday morning - before the violence - the U.S. Embassy in Egypt wrote that it "condemns the continuing efforts by misguided individuals to hurt the religious feelings of Muslims – as we condemn efforts to offend believers of all religions."

"Respect for religious beliefs is a cornerstone of American democracy," the statement continued. "We firmly reject the actions by those who abuse the universal right of free speech to hurt the religious beliefs of others."

Some U.S. officials spoke to the tension between U.S. support for free speech and what some have described as the film’s “hate speech,” in reacting to the attacks.

"The United States deplores any intentional effort to denigrate the religious beliefs of others," U.S. Secretary of State Hillary Clinton said in a statement.

"Our commitment to religious tolerance goes back to the very beginning of our nation,” she said. “But let me be clear: There is never any justification for violent acts of this kind."

Some other political and religious leaders also cited the tension between free speech and what they said was hate speech. "I support #freespeech AND believe this film is hateful," tweeted Eboo Patel, an American Muslim leader based in Chicago. "I stand up for #Islam AND condemn violence of extremist Muslims #fb #responsibility."

Others joined in venting disapproval of both the film and the attacks. "For the record, you can condemn violence in response to hate speech, and you can also condemn hate speech," wrote Jeff Fecke on Twitter. "You don't have to support either."

Some American Muslims said Wednesday that while they support the right of free speech, they believe that the U.S. applies its values selectively in the Muslim world, especially when it comes to military and intelligence operations.

“Freedom of speech falls alongside other freedoms to live and be free from bombs falling on people’s heads and to be free from occupations,” says Omid Safi, religious studies professor at the University of North Carolina, referring to American military and intelligence operations in parts of the Muslim world.

“I will take free speech comments seriously when others take people’s freedom of life and dignity and to be free from occupation just as seriously,” he said.

    Read the newspaper. There is personal attacks, hate speech, bullying in every section. From the front page to the editorials. Even the sports page is full of hate speech as players, owners, officials and everyone else is downgraded by ignorant sports writers. News journalists are root of all hate. They are teaching people and kids how to be bullies. It may be time to declare news journalists truth terrorists, put them on the do not fly list, and sue them for bullying.

    The Taliban, AL QEADA types use these FILMS to incite violence because that is how they stay in power. Want to defeat them? Then EDUCATE yourself. don't allow them to use our ignorance to fuel their power.

    The violence used in response to these videos is a beacon of the childishness, backwardness, and ignorance of the religion over there that causes so much trouble.

    In another article one Islam sympathizer said something like "What would you Americans do if someone did this to Christianity." The answer is absolutely not violence. That's the whole point. And it happens all the time. Daily. On the second practically. It's called the Internet.

    The subject of "hate speech" shouldn't even be mentioned. This is an untenable violent response to a video. A video. There is no excuse for this type of behavior and nobody should so much as breath "religious tolerance" until they can handle it with words.

      You nailed it – The film is an exercise of free speech that should not be suppressed – this is not a case of yelling "fire" in a crowded theater. We may not agree with what is expressed, but we should protect free speech no matter what the cost – anything less is bowing to tyranny. And I find it offensive that some people are apologizing for our free speech – they can condemn the message but please do not apologize for our right to express it!

    Hate speech IS free speech.The U.S. Supreme Court stated the general rule regarding protected speech in Texas v. Johnson (109 S.Ct. at 2544), when it held: "The government may not prohibit the verbal or nonverbal expression of an idea merely because society finds the idea offensive or disagreeable." Federal courts have consistently followed this. Said Virginia federal district judge Claude Hilton: "The First Amendment does not recognize exceptions for bigotry, racism, and religious intolerance or ideas or matters some may deem trivial, vulgar or profane."

    1) The Constltution is the Supreme Law of this land.
    That means that all religious laws and anything else is subject to our nation's laws and authority.
    There is no way to get around this basic fact.

    2) The First Amendment states: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

    So here we have a clear enough set of rules:
    Our government is prohibited from making any laws whatsoever that support or restrict any particular religion. This is to ensure that all people are equally represented in how the country is governed.

    Religious people must follow the law, period.
    A religion is in no way given free rein to do as it likes by the First Amendment, nor is it given some strange authority to demand special treatment or respect in any way.

    A religion is not a person and has no rights here.

    Criticism is protected speech, as is satire, parody, ridicule, insults, and other "offensive" forms of speech.

    Religious freedom MUST include the right to be free OF religion or else the law makes no sense and is worthless.

    And Free Speech MUST be allowed to be "offensive" no matter how foul or disgusting it may appear as long as it is legal in every other way..
    If our government attempts to protect any religion, it violates the Constltution by default.
    It is not our job to protect any religion from ridicule or offense and I hope it never will be.

    To say the United States "deplores" some individual's protected speech is to seek to illegally curb that speech when said by a top government official.
    Religion does not get a free pass no matter how violent the psychotics are that follow it.
    Their violence is the crime here. Speaking rudely is not a crime. Making parodies and satire is NOT A CRIME HERE!!!

      You do not have the right to demand special laws that discriminate on an unequal basis.

      You also do not have the right to special consideration.
      The law is to be applied equally regardless of whether you like it or think it's a good idea or not.
      We are not responsible for what others do. That would be ridiculous beyond words.

It may be our opinion that the film should not have been made, but we should defend to the death the right that allowed it to be made. One person's good idea can easily be another person's bad idea. I am sure that the English did not think that the idea of a "United States" was a "good" idea in 1776!

    The United States protects the right of free speech because it allows this kind of hateful speech. That in turn fosters discussion and condemnation of such sentiments. It's important to remember that we got where we are today by peacefully protesting and changing the culture in which we live, not by executing the seditious.

    Unfortunately freedom of speech requires defense because evil people will always endeavor to suppress it. These days, that includes the majority of Muslims out there, misguided by their religion. If Muslims are willing to kill innocent and good people because they are offended, that's unfortunate, but it's not a good reason to do what they want. It's a good reason to continue offending them, actually. These deaths are not in vain. and the more of them there are, the more we can come together and accept that the concept of "blasphemy" really is something that cannot be tolerated by a lawful and civilized society. Don't give in to terrorists.

      when was Obama ever concerned about being politically correct when it came to killing terrorists? He's killed many more than Bush ever did through his extensive use of drones and has not shied away from entering into legal grey areas if it means getting the job done and making the world and the US safer and more secure.       When will people like you learn that invoking your personal beliefs as a panacea insults everyone who doesn't buy into your mythology through your passive/aggressive assertions for it.
