Split ruling on discrimination against UK Christians

London (CNN) - A British Christian woman suffered religious discrimination when British Airways told her not to wear a visible cross over her uniform, a top European court ruled Tuesday.

However, three other British Christians lost related religious discrimination claims at the European Court of Human Rights.

British Airways violated the article of the European Convention on Human Rights that guarantees freedom of religion when it stopped employee Nadie Eweida wearing her cross openly, the court said.

Eweida said she experienced discrimination from 2006 to 2007, when she started wearing the cross visibly and was transferred to another job. The airline has since changed its policy on uniforms to allow employees to wear religious or charity symbols.

    I agree with allowing religious symbols to be worn in public spaces but as an employee this should be different. No personal opinions should be expressed to customers while on the job. If you can't hack that, stay out of the workforce. The European Convention on Human Rights has gone way to far in it's efforts to appease religious groups.

      Since allowances have been made for the hijab, I suspect BA pretty much had to roll over.

      I get the impression that there was more to the flight attendant story than the 'facts' of the case.

      It has been accepted for a very long time that customer facing employees with uniform requirements – like airline employees: pilots, flight attendants and agents – often have a pretty strict dress code.

    They shouldn't get special rights because of the stories they believe. If their employer doesn't want them to wear it, then they should take it off or quit. I could just as easily say I want to wear spaghetti on my head because of my Pastafarian beliefs, should my boss be expected to put up with that? Believing in nonsense doesn't give you special privelages.

      In Austria, it is permissible to have your driver's license photo taken when wearing "confessional" headgear.
      Mr. Niko Alm had his license photo taken while wearing his own religious haberdashery – a pasta strainer.
      The authorities required the pastafarian to obtain a doctor's certificate that he was "psychologically fit" to drive, though other religious persons aren't required to do so.

      I have mixed feelings on this. I don't like giving corporations too much power over peoples lives, so I like them being made to treat people equally. Dress codes should be consistent and not pay any special attention to religious items.

      If a dress code allows charm necklaces to be worn, then there is no reason a cross or other religious symbol couldn't be worn just as easily as some other meaningless charm. This would be consistent.

      When workplaces say "no hats", but then allow muslims to wear their headgear, that is inconsistent.

      That headgear should be allowed only if I'm allowed to wear my redneck uniform (baseball cap). That is consistency.

      The sad thing is, it was never about them wearing the decoration. They would easily be able to wear such things if they didn't have to show everybody they encountered just how righteous they were. But then they would be failing god.
