Muslims sue over New York police surveillance

(CNN) - New Jersey Muslims filed a lawsuit against the City of New York on Wednesday, accusing police of using unconstitutional tactics to spy on them in the years after September 11, casting an unwarranted shadow of suspicion on the community.

"The NYPD's program targeted innocent Americans solely based on their religious identity," said Farhana Khera, president and executive director of the legal advocacy group Muslim Advocates, which filed the suit on behalf of the eight plaintiffs.

"That's why we believe it is unlawful and needs to stop," Khera said.

Muslim Advocates says it wants an end to the department's "invasive and discriminatory" surveillance program, which it claims targeted at least 20 mosques, 14 restaurants, 11 retail stores, two grade schools and two Muslim student associations throughout New Jersey. The group also wants all related records from the covert program expunged, according to the complaint.

According to NYPD Deputy Commissioner Paul Browne, police were in compliance with overarching counterterrorism efforts and standards.

"I refer you to the New Jersey Attorney General's report and to the fact that NYPD activities in New Jersey were lawful, appropriate, and in keeping with efforts there, in New York, and around the world to prevent terrorists from returning here to kill more New Yorkers," Browne said in e-mail.

In May, after a three-month review, New Jersey Attorney General Jeffrey Chiesa declared that New York police did not violate any laws when they carried out surveillance programs across state lines.

The details of the program emerged in August and included a 60-page report, obtained by The Associated Press, showing NYPD maps of Newark and photographs of Muslims' residences and mosques. There was no statement in the document regarding terrorism or criminal activity.

W. Deen Shareef of the Council of Imams in New Jersey, which is among the plaintiffs, said more people are uncomfortable with coming to the mosque to pray because they feel that they are being watched.

"People are concerned with going about their day-to-day life," Shareef said.

The owners of a Newark halal grocery store, also suing the city, say they lost a lot of regular customers since photographs of the market emerged in the report.

"It has draped a blanket of suspicion over the Muslim-American community and over the people outside of the community that associate with its members," Shareef said.

Shareef, Khera and the other plaintiffs - including a decorated U.S. Army Reservist and a Rutgers College student - say they hope this lawsuit will help lift that blanket.

"What makes America great is that we don't treat each other differently based on on how someone looks or how someone prays," Khera said.

"The Constitution guarantees that every American can be treated equally under law, and we expect government officials to do the same."

    This country belong to Muslim Americans as much as it belong to Christian Americans. Nobody can tell nobody to go back et al. What if I tell Christian Americans to go back to England or Italy or wherever they originated.

    I find most comments here based on profound ignorance, hate, bigotry and prejudice. It might help if you learn something about Islam first. We denounce all acts of violance and terrorism; includng those by religious extremists (including al-qaida, hamas and what not) as well as those sponsored by sovereign states.

    Unfortunately it is many of you who are not willing to condemn the acts of terrorism done from you end; including those done by Israel to Palestinians, and those done by the illegal wars in Iraq and Afghanistan, or those done through support of many of the illegal regimes in some of the Arab countries such as Saudia and Bahrain. Many of your comments show the hatred and bigotry that walks the street these days.

    Before everyone starts clamoring that Muslims are the ones starting wars please do some simple research. It was the Cristian west that invaded pretty much all Muslim countries (Morocco, Algeria, Tunisia, Egypt, Sudan, Somalia, Palestine, Syria, Jordan, Ottoman Empire, Iraq, Kuwait, Oman, Yemen, Pakistan) and had a monopoly on middle eastern Oil until the 1970's ( Saudi Arabia, and Iran) just some perspective to the short memories everyone seems to have. Muslim dominated countries have only fought internally and compared to the amount of wars and invasions led by Europeans and Americans would be considered hippies. And don't tell muslims to "assimilate" many came here before 9-11 and own their own enterprises, many are doctors and engineers.

    We are appropriately still going berserk 11 years after 9/11, but nobody understands why Europe was so very anti-this and anti- that throughout the 20s, 30, and 40s. Those folks witnessed the Bolshevik revolution presented by a cabal that killed nine million, executed the greatest redistribution of wealth in history, and bayonetted four little girls of the royal family. We are still scared today but we can't understand why Europeans were scared to death back then?

    Radical Muslims seem to be a significant percentage of "home-grown" terrorists. I've not read that the Muslim community at-large is providing information to authorities about the activities of the radicals among them. If this is happening, I believe it would be very helpful to non-Muslim Americans to learn about such activity and acts of patriotism. At the same time, this knowledge would benefit the the Muslim community by decreasing the perception of threat from them.

Even the Christian church comes out almost immediately when one of their own does something evil. Not that I'm defending christianity because frankly their turning into the American taliban, but the writing is on the wall when it comes to muslims in general. They have a minority that want peace that is so far away from what the majority want and show they want every day by their actions and silence when those actions take place.

    Another major item to delete. There are no books written in the spirit state of Heaven (if there is one) just as there are no angels to write/publish/distribute them. The Koran, OT, NT etc. are simply books written by humans for humans.

    Prophets were invented by ancient scribes typically to keep the un-educated masses in line. Today we call them for-tune tellers.

Did you all ever just think that person was crazy. The oklahoma bomber was a christian so he said, did we condemn christianity, ofcourse not. The KKK were all whites with all the evil they did throughout time, is it fair for everyone not like them to look at all whites and assume they are KKK.     We lose our liberty at the cost of "security" and the masses applaud! The question is...how much freedom are you willing to lose in the name of security? If we don't have freedom then there is nothing unique about the U.S. Our freedoms are what the extremists hate....so we let them win by taking freedom away from americans. Just keep feeding big brother....one day at a time. You might look at things differently when its your liberty being taken away.

      when the muslim "charities" and islamic centers in the US, not to mention the mosques, stop raising money for hezbollah and other terrorist organizations dedicated to killing americans, like the marines in Lebanon in 1983 and the "insurgents" in Iraq and Afghanistan dedicated to the killing of Americans, your comments will no longer be "Too Much", Too Much. The lawsuit is not well founded and only in America would it be tolerated.     Now, the muslims want to sart a new legal war against the US. What if the families of the more than 3000 Americans killed in the terrosrist attack sue all the muslims? They would be better off asking their jihadhst btothers and sisters to stop with their terrorism acts so they can enjoy more freedom in the country that welcomes them. Blame it on your radicalist muslims brothers and sisters.
